A labor lawyer warns of bad news for workers regarding personal days: "People think they have rights just because they work."

Personal leave allows employees to take paid leave without having to provide justification, as the name suggests. They only need advance notice and, perhaps obvious but worth remembering, they have the right to take it. Indeed, not all employees are in this situation.
Lawyer Juanma Lorente warned about this on his TikTok account. He asserted that many citizens are confused about personal days, a right that is far from guaranteed to all workers.
"You're wrong about personal days," Lorente said, explaining that " people think they're entitled to personal days because they work, and that's not the case ."
In fact, according to the lawyer, " it's quite possible that you won't be entitled to even one personal day all year ." Lorente also states that in such cases, it's "completely legal" for the company to deny them.
The key lies in the Workers' Statute. Or rather, in the Statute's lack of specifics, which fails to recognize employees' right to these days. In short, these days are not a right, as such, of workers.
The key is in collective agreementsLorente recommends that employees review the collective bargaining agreement that applies to them. These texts, if applicable, outline employees' right to personal days and the conditions under which they should be taken.
" If your collective bargaining agreement doesn't state that you are entitled to personal days, you can't take them no matter what, " warned Lorente, who invited workers to consult their collective bargaining agreements to finally resolve any doubts.
